In 2006 the drive was closed to vehicles so the Tahuna wastewater outfall pipeline could be built. Vehicle access has been debated ever since. The council briefly reopened the road to cars in 2009, then closed it again in October that year over public safety concerns.
In 2011 it proposed changes to the Ocean Beach Domain management plan so that vehicle use could be controlled to protect public safety, the dunes and recreational use.
Today the drive is part of the Ocean Beach Domain and works mainly as a shared path, with cars allowed only in a limited weekday window set by the Dunedin City Council. The drive ends near Lawyers Head, the 34 metre headland it was developed to open up.
